Specified operator bushfire mitigation plans

Requirements relating to specified operator bushfire mitigation plans (BMP) under the Electricity Safety Act 1998 (Act) have changed. This page provides an overview of these changes, and what they mean for specified operators.

Specified operators and their obligations

Specified operators manage at-risk electric lines, which are overhead power lines in hazardous bushfire risk areas (HBRA). They typically operate smaller networks linked to wind, solar, and hydro plants, as well as coal facilities, mines, or manufacturing sites. For information on HBRA see Data Vic website.

Under the Act, specified operators have a general duty to design, construct, operate, maintain and decommission at-risk electric lines to minimise the bushfire danger arising from those lines as far as practicable. Specified operators must also prepare and submit to Energy Safe for acceptance a BMP showing how they will meet their general duty. A specified operator cannot operate at-risk electric lines during the bushfire risk period (1 November to 31 March) without an accepted BMP.

Changed requirements

As a result of legislative changes that came into effect in May 2025, specified operators must now:

  • submit a BMP to us at least every 5years, instead of annually
  • revise a BMP before their 5-year anniversary date in certain circumstances
  • revise a BMP when requested by us.

Preparing BMP submissions

We encourage specified operators to engage with us as early as possible when preparing their BMPs. Early engagement may include discussing the scope and objectives of the BMP, identifying any anticipated issues, or clarifying the assessment process and expected timeframes. Further guidance for BMPs

We are developing guidance to assist specified operators in preparing their BMPs. This guidance will outline the legislative requirements and our expectations for BMPs.

The guidance will be subject to public consultation where all stakeholders will get the opportunity to provide feedback. We will carry out this process in line with our Charter of consultation and regulatory practice:
